Welcome to the Buckley and Beale website Terms and Conditions page. When you place an order with us you agree to be bound by these Terms and Conditions to the exclusion of any other terms that you may seek to impose or incorporate, or which are implied by trade, custom, practice or course of dealing.  These Terms and  Conditions are the contract between us and may only be varied unless agreed in writing by us.

 

YOUR ACCOUNT

Please ensure that the details you provide when registering an account with us are correct, complete and up-to-date.  Please let us know immediately if any of your details change, including email and postal address. You are responsible for preventing unauthorised access to and use of your account. Please ensure that you protect the confidentiality of your username and password. 

 

PAYMENT

All orders will be processed on a proforma basis. All orders must be paid for before the order can be placed with our suppliers. Once payment has been received the order will be dispatched. Please note, many of our items from the US are shipped to order, with an eight-week lead time. Payment may be made by credit card or by BACS transfer. All goods supplied by Buckley and Beale Ltd remain the property of Buckley and Beale Ltd until paid for in full.

 

PRICES

We will do our best to give you advance notice when prices change, however this cannot be guaranteed. Buckley and Beale reserve the right to pass any price increases from our suppliers onto our customers. 

 

CLAIMS

Any damaged goods must be reported within 24 hours of delivery and we will require a photograph of the damaged item(s).  Any damage to outer cartons must be signed for as damaged. You must notify us of shortages or any other issues, in writing, within 24 hours of delivery, or the next working day. 

 

RETURNS

No returns will be accepted unless they have been approved and booked in with our sales team.  

 

SELL-BY DATE

Buckley and Beale cannot give refunds for stock that remains unsold after its best before date. It is the customer’s responsibility to ensure correct stock rotation.

 

DELIVERIES

We aim to deliver all in-stock items within five working days. Any special requirements for deliveries must be notified at the time of ordering. Deliveries which are turned away without such notification must be paid for. Late delivery cannot be accepted as a reason for refusing products unless Buckley and Beale is informed in writing of this before the products are dispatched.

 

PRIVACY POLICY

We collect personal information when you register with us, and when you place an order from our website or by phone. The information is used to enable us to process and deliver your orders. By registering your details on our website, you agree to our recording, holding, maintaining and using personal data that you supply.

 

When you register for our website you will be given the option of signing up to our email newsletter. You may opt out of this service at any time. We will never give, sell, or swap any of your details to any third party. But, if you wish to have your details removed from our database, please call or email us, and we shall remove them.

 

ALTERATIONS TO THE WEBSITE, AND TO THE TERMS AND CONDITIONS

We reserve the right at any time to make changes to this website and our Terms and Conditions. You will be subject to the policies and Terms and Conditions in force at the time you use the website or order items from the website. 

 

BASIS OF CONTRACT

These Terms and Conditions constitutes the entire agreement between the parties. You acknowledge that you have not relied on any statement, promise, representation, assurance or warranty made or given by us or on our behalf of the Supplier which are not set out here. Any descriptive matter or advertising produced by us and any descriptions or illustrations contained in or on our website  or brochures are produced for the sole purpose of giving an approximate idea of the products. They shall not form part of the contract or have any contractual force.

 

LIMITATION OF LIABILITY

We shall under no circumstances whatever be liable to you, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, for any loss of profit, or any indirect or consequential loss arising under or in connection with these Terms and Conditions and the contract between us.

 

Our total liability to you in respect of all other losses arising under or in connection with the Contract, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall in no circumstances exceed the price of the goods.

 

GOVERNING LAW

These Terms and Conditions are governed by and written in accordance with the laws of England and Wales. You agree to submit to the non-exclusive jurisdiction of the English courts.
